Re: 'NAR crosses swords with DOJ over real estate site' (Oct. 23)

Dear Editor:

This is a great article that I almost totally agree with. I was at the CMLS conference a couple of weeks ago and for the first time heard the DOJ and the FTC side of the issue. It did not change my mind that the lawsuit is ludicrous, but it was nice to hear the other side.

Credit crunch weighs on housing prices

Standard & Poor's today released its S&P/Case-Shiller U.S. National Home Price Index for August 2007, and the credit crunch that recently roiled the mortgage market weighed heavily on home prices. Of the 20 markets tracked by the index, only five remain in positive territory over the past year.

However, the rate of appreciation in those markets has slowed, and even Seattle, the strongest market, showed a small monthly price decline. In fact, only two markets -- Charlotte and Denver -- showed a price increase for the most recent month.  more...

To me, this carnage should be fixed by the companies that created it -- period. These loans that are foreclosing at such enormous rates could be salvaged if the Bush administration mandates that those lenders who approved the defaulting loan be required to modify it (loan modification).  more...

Dear Editor:

Are semantics clouding the real issue? When you have thousands of real estate agents competing for a limited amount of business this is construed as competitive, just as Realogy and RE/MAX suggest. However, this does not equate to competitive real estate models, which should -- but do not -- benefit consumers.  more...

The biggest problem with the NAR, of which I am a member, is the fact that it is a business that is fueled primarily by the big franchises whose interests the NAR always seems to prioritize.

If you want to talk about monopolies, let's look at the NAR. Where's the competition there?  more...

Justice not served in real estate dispute

"The case concerns the fate of a large inheritance, but has dragged on for many generations prior to the action of the novel, so that, by the time it is resolved late in the narrative, legal costs have devoured nearly the entire estate. The case is thus a byword for an interminable legal proceeding."

That's Wikipedia's succinct description of Jarndyce v. Jarndyce, the interminable lawsuit that formed the backbone of Charles Dickens' novel "Bleak House."

As I just spent seven hours in deposition in Boston yesterday in testimony on the now-infamous DOJ v. NAR case. I concur with Marcie Geffner's perspective that the VOW issue in itself will be, and is now, a moot point as the main issue of contention, as new technologies and national online real estate platforms take center stage in the open source of listing information.  more...

Hey, NAR, here's an idea: Why don't you stop whining to the DOJ about fairness, fair play, and who gets to do what, when and where?

Instead, why don't you spend your time pushing the government to require all real estate brokers to carry liability insurance -- like any other reputable profession in the country?  more...

As usual, Inman is ahead of the story; this time by floating this comment by Mary Jo Quay. Between this quote and the pricing letter from the teacher at the college, a pretty dismal frame of reference is definitely established.

The fact is, people I have spoken with on the subject believe that we are in for a shrinking of the agent population over the next two years by 30-40 percent!  more...
